Welcome to TestFast! These Terms of Service ("Terms") govern your use of our platform and services. By accessing or using TestFast, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using TestFast, you confirm that you:

• Are at least 13 years old (or the age of consent in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Will comply with all applicable laws and regulations
• Agree to these Terms and our Privacy Policy

If you do not agree to these Terms, you may not use TestFast.

2. Description of Service

TestFast is a platform that helps founders validate startup ideas by providing tools to:

• Create landing pages and signup forms
• Track analytics and signups
• Generate AI-powered marketing plans and content
• Test and iterate on ideas quickly

We reserve the right to modify, suspend, or discontinue any part of our service at any time, with or without notice.

3. Account Registration and Security

3.1 Account Creation

To use TestFast, you must create an account by providing:

• A valid email address
• A secure password
• Payment information (for paid plans)

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

TestFast is not liable for any loss or damage arising from your failure to protect your account.

3.3 Accurate Information

You agree to provide accurate, current, and complete information and to update it as necessary.

4. Subscription Plans and Payments

4.1 Paid Plans

TestFast offers subscription plans with different features:

• Starter Plan: $29.99/month
• Pro Plan: $49.99/month

Plan details, features, and pricing are subject to change with 30 days' notice.

4.2 Billing and Payments

By subscribing to a paid plan, you agree that:

• Payments are processed securely through Stripe
• Subscriptions renew automatically each billing cycle
• You will be charged the then-current rate for your plan
• All fees are non-refundable except as required by law

4.3 Cancellation

You may cancel your subscription at any time:

• Cancellations take effect at the end of the current billing period
• You will retain access until the end of your paid term
• No refunds will be issued for partial months

4.4 Failed Payments

If a payment fails:

• We will attempt to reprocess it
• Your account may be suspended until payment is resolved
• We reserve the right to terminate accounts with overdue payments

5. User Content and Intellectual Property

5.1 Your Content

You retain ownership of all content you create on TestFast (landing pages, copy, images, data). By using TestFast, you grant us a limited license to:

• Host, store, and display your content
• Process your content to provide services
• Make backups for reliability and security

This license ends when you delete your content or terminate your account.

5.2 TestFast's Intellectual Property

All rights, title, and interest in TestFast (including software, design, logos, trademarks) remain the property of TestFast. You may not:

• Copy, modify, or reverse-engineer our platform
• Use our trademarks without permission
• Remove any copyright or proprietary notices

5.3 Prohibited Content

You may not create or share content that:

• Is illegal, fraudulent, or misleading
• Infringes on intellectual property rights
• Contains malware, viruses, or harmful code
• Harasses, threatens, or defames others
• Violates privacy or data protection laws
• Promotes violence, hate speech, or discrimination

We reserve the right to remove prohibited content and terminate accounts that violate these rules.

6. Acceptable Use Policy

You agree not to:

• Use TestFast for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Scrape, spider, or harvest data from TestFast
• Impersonate others or misrepresent your affiliation
• Use TestFast to send spam or unsolicited communications
• Resell or redistribute our services without permission

7. AI-Generated Content

TestFast uses AI to generate marketing plans, social media content, and other materials. You acknowledge that:

• AI-generated content is provided "as-is" and may not be perfect
• You are responsible for reviewing and editing AI output
• You should verify accuracy before publishing AI-generated content
• TestFast is not liable for errors or consequences of using AI content

8. Third-Party Services

TestFast integrates with third-party services (e.g., Stripe, Supabase). Your use of these services is subject to their own terms and policies. We are not responsible for:

• Third-party service outages or failures
• Changes to third-party pricing or features
• Data practices of third-party providers

9. Disclaimers and Limitations of Liability

9.1 No Warranties

TestFast is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted, secure, or error-free service
• Accuracy or reliability of content

9.2 Limitation of Liability

To the fullest extent permitted by law, TestFast shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use our services

Our total liability to you shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Indemnification

You agree to indemnify and hold TestFast harmless from any claims, damages, or expenses arising from:

• Your use of TestFast
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you create or share on the platform

11. Termination

11.1 By You

You may terminate your account at any time through your account settings. Upon termination:

• Your subscription will not renew
• You will retain access until the end of your paid term
• Your data will be deleted within 30 days

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay outstanding fees
• Engage in fraudulent or illegal activity
• Create security or legal risks for TestFast

We will provide notice when reasonably possible, but may terminate immediately in cases of serious violations.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of TestFast after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that if you are a consumer resident in the UK or the EEA, you may bring proceedings in your country of residence and you may benefit from any mandatory provisions of local consumer protection law. Nothing in these Terms affects your statutory rights.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TestFast.

15.1 Territorial Scope

We are established in the United Kingdom and provide services worldwide. Where local law grants you mandatory rights (for example, consumer protection rules in your country of residence), those rights are not affected by these Terms.
